{Bava Kamma 97b}
מטבע היוצא באותה שעה
ושמואל אמר יכול לומר לו לך והוציאו במישן
אמר רב נחמן מסתברא מילתא דשמואל דאית ליה אורחא למישן אבל לית ליה אורחא למישן לא:
with the coin that had currency at that time,.
And Shmuel said: he can say to him {=the creditor} 'Go forth and spend it in Meshan.'
Rav Nachman said: The position of Shmuel is logical where he had occasion to go to Meshan, but if he did not have occasion to go to Meshan, no.

בעא מיניה רבא מרב חסדא המלוה את חברו על המטבע והוסיפו עליו מהו
א"ל נותן לו מטבע היוצא באותה שעה
א"ל ואי כי נפיא
א"ל אין
א"ל ואפי' כי תירטא
א"ל אין
והא קא זילי פירי
אמר רב אשי ניחזי אנן אי מחמת טיבעא זול מנכי ליה ואי מחמת תרעא זול לא מנכי ליה
והא קא שבח לענין נסכא
אלא כי הא דרב פפא ורב הונא בריה דרב יהושע עבדו עובדא בזוזא דאגרדמים טייעא עד עשרה בתמניא
Rava inquired of Rav Chisda: If he lent to his fellow on {condition of repayment by} a certain coin, and that coin meanwhile was made heavier {/more valuable}, what is the law?
He {=Rav Chisda} said: He gives him coins that have currency at that time.
He {=Rava} said to him: Even if the new coin be of the size of a sieve?
He {=Rav Chisda} said to him: Yes.
He {=Rava} said to him: Even if it be of the size of a 'tirtia'!? {=a ring of a certain size}
He {=Rav Chisda} said to him: Yes.
But in such circumstances would not the products have become cheaper {and it would be usury}?
Rav Ashi said: We should see if it was through the {increased weight of} coin that prices ropped we would have to deduct {from the payment accordingly},

but if it was through the market supplies that prices dropped, we would not have to deduct anything.

But he {=the creditor} would benefit in terms of the {added} metal?!
Rather, like this, that Rav Pappa and Rav Huna son of Rav Yehoshua acted in practice {ruling in a case} regarding zuzim, according to {information from} an Arabian agoran {market commissioner} with for 10 {coins} for 8 {coins}.

פירוש כגון דהוה ליה גביה חבריה מאה זוזי כל זוזא מינייהו אית ביה תמניא פריטי ואוסיפו עליה השתא ועבדוניה לכל זוזא עשרה פריטי חזינן אי לא קא זילי פירי מחמת ההיא תוספת אלא תרעא כדקאי קאי יהיב ליה השתא מאה זוזי מהאי טיבעא דהוא סכום כל מה דאית ליה גביה מההוא טיבעא קמא ולא מנכי ליה כלום
ואע"ג דקא שבח לענין נסכא חומשא מלבר דאינון תרתי פריטי בכל [זוזא] כיון דליכא גביה שבחא לענין פירי לא איכפת לן בההיא תוספת חומשא דאיכא בנסכא
והיינו דקאמר רב חסדא נותן לו מטבע היוצא באותה שעה
To explain, such that he had by his fellow 100 zuz, each zuz has within it 8 pritin {small silver coins}, and now there were added to it, such that each zuz has 10 pritin -- we see: if the products did not become cheaper because of that addition, but rather the market-price remained in place, then he gives him now 100 zuz from that coin, which is the sum of all that he had from that original coin, and does not deduct from it all at. And Even though it increased in terms of metal 1/5 from the outside, which it 2 pritin to each [zuz], since there is not by it an increase in terms of produce, it matters not to us that increase of 1/5 that there was in the metal. And this is what Rav Chisda said: He gives him a coin which is current at that time.

ואי קא זילי פירי מחמת ההיא תוספת אפילו לא אוסיפו עליה אלא כל שהוא מגבי ליה מהאי טיבעא כוותיה ואי אוסיפו עליה טפי מחומשא אע"ג דלא קא זילי פירי לא יהיב מהא טיבעא דנפיק אלא כשיעורא דאית ליה מטיבעא קמא וכ"ש אי קא זילי פירי דמנכי ליה כל דהוא טופיאנאה דאוסיפו ליה עד גמירא
והוא הדין למלוה את חברו על המטבע ופחתו ממנו והוא הדין נמי במקום שנושאין ונותנין בכספים של משקל ופוחתו מן הכסף שבהן או שהוסיפו עליו הכל ענין אחד הוא:
And if the price of produce goes down because of that increase, even if they only increased it a slight about, he collects from that coin like it; and if they added upon it more than 1/5th, even though the price of produce did not go down, he does not give from that coin which goes out {=is current} except in accordance with the measure that he had from the first coin; and all the more so if the price of produce went down, that he deducts all the surplus which was added to it until completion.
And the same is the law for one who lent his fellow upon {=to be paid back in} a certain coin, and they reduce from it {, the coin}, and so is the law as well where they engage in trade in coins of weight, and they reduce from the silver in them or they add upon it, all is the same matter.

הא דאמר רבה הזורק מטבע של חבירו לים הגדול פטור והצורם באוזן פרתו של חבירו פטור והשורף שטרותיו של חבירו פטור לית הלכתא כוותיה בכלהו
דהא אסיקנא אמר אמימר למאן דדאין דינא דגרמי מגבי ביה דמי שטרא מעליא ולמאן דלא דאין דינא דגרמי מגבי ביה דמי ניירא בעלמא הוה עובדא וכפייה רפרם לרב אשי ואגבייה כי כשורא לצלמי
וכן הלכתא
This that Rabba said: He who throws a coin of his fellow into the great sea {=the Mediterranean} is exempt; and he who splits the ear of another's cow {making it invalid for the altar} is exempt; and one who destroyed by fire deeds {of credit} of his fellow is exempt -- the halacha is not like him in all of them. {Rather, he is liable.}
For behold we conclude {Bava Kamma 98b}:
Amemar said: According to the one {=Rabbi Meir} who maintains that we judge the law of indirect cause, he may collect in this the value of a perfect shtar, while according to the one who does not maintain that we judge the law of indirect cause, he may only collect the value of the paper. There was an incident and Rafram compelled Rav Ashi to order collection of it as a beam fit for decorative mouldings. And so is the halacha.

אלא מיהו ה"מ היכא דקא מודי ליה דקושטא קא טעין עליה ומחמת דשריף ליה לשטריה הוא דלא מצי גבי ליה
אבל היכא דלא קא מודי ליה דקושטא קא טעין אי נמי מודי ליה ולאו מחמת דשריף ליה לא מצי גבי לא מיחייב
כדאמרינן מתקיף ליה רמי בר חמא היכי דמי אי איכא סהדי דחתימי עלה דידעי מאי הוה כתיב בשטרא ניכתוב ליה שטרא אחרינא ואי דליכא סהדי מנא ידעינן
אמר רבא תהא במאמינו:
However, these words are where he admits to him that it is truth that he argues upon him, and since he burnt his shtar, that is why he cannot collect. But where he does not admit that he is arguing truthfully, or alternatively, where he admits to him, but it is not because it was burnt that he cannot collect, he is not liable. As we say:
Rami bar Chama objected to him: How so? If there are witnesses who signed upon upon it that know what was written, let them write him another shtar! And if there are no witnesses, from where do we know {the contents}?
Rava said: Where he believes him {as to the contents}.


פירות והרקיבו משלם כשעת הגזלה
והא תניא פירות והרקיבו אומר לו הרי שלך לפניך
אמר רב פפא לא קשיא כאן שהרקיבו כולן כאן שהרקיבו מקצתן
"FRUITS AND THEY ROTTED, HE WOULD PAY ACCORDING TO THE TIME OF THE ROBBERY":
But they learnt {in a brayta}: Fruits and they rotted, he may say to him "here are yours before you?"
Rav Pappa said: This is no contradiction. Here is where all of them rotted, and here is where parts of them rotted.

נתן לאומנין לתקן וקלקלו חייבין לשלם
נתן לחרש שידה תיבה ומגדל לתקן וקלקל חייב לשלם:

הבנאי שקבל עליו את הכותל לסותרו ושיבר את האבנים או שהזיקן חייב לשלם
היה סותר מצד זה ונפל מצד אחר פטור
ואם מחמת המכה חייב:
IF AN OWNER GAVE CRAFTSMEN [SOME ARTICLES] TO SET IN ORDER AND THEY SPOILT THEM, THEY WOULD BE LIABLE TO PAY.
WHERE HE GAVE A JOINER A CHEST, A BOX OR A CUPBOARD SET IN ORDER AND HE SPOILT IT, HE WOULD BE LIABLE TO PAY.

IF A BUILDER UNDERTOOK TO PULL DOWN A WALL AND BROKE THE STONES OR DAMAGED THEM, HE WOULD BE LIABLE TO PAY;
IF WHILE HE WAS PULLING DOWN THE WALL ON ONE SIDE ANOTHER PART FELL ON ANOTHER SIDE, HE WOULD BE EXEMPT;
AND IF IT WAS CAUSED THROUGH THE KNOCKING, HE WOULD BE LIABLE.

Gemara:
אמר רב אסי לא שנו אלא שנתן לחרש שידה תיבה ומגדל לנעוץ בהן מסמר ושיברן
אבל נתן לחרש עצים לעשות מהן שידה תיבה ומגדל ועשה מהן שידה תיבה ומגדל
Rav Assi said: They only learned this where he gave to the joiner a box, a chest, or a cupboard to knock a nail in and {while doing so} he broke them. But if he gave to the joiner timber to make a chest, a box or a cupboard and he had made the box, the chest or the cupboard,
