34b

{Bava Kamma 96b}
Gemara:

אמר רב פפא לא הזקינה ממש אלא אפי' כחשה
והא אנן הזקינה תנן אמרי כחשה כעין הזקינה
מה הזקינה דלא הדרה אף כחשה דלא הדרה אבל כחשה דהדרה אומר לו הרי שלך לפניך:
Rav Pappa said: The expression IT BECAME OLD does not necessarily mean that it actually became old, for [the same law would apply] even where it had otherwise deteriorated. But do we not expressly learn IT BECAME OLD? This indicates that the deterioration has to be equivalent to its becoming old, where it will no more recover health. But a deterioration where it will recover health, he may say to him, "behold, yours is before you."

רבי מאיר אומר אומר לו בעבדים הרי שלך לפניך:
אמר רב חנינא בר אבדימי אמר רב הלכה כרבי מאיר
ולית הלכתא כותיה דקי"ל עבדא כמטלטלי דמי:
"RABBI MEIR SAYS THAT IN THE CASE OF SLAVES HE MIGHT SAY TO THE OWNER, 'HERE TAKE YOUR OWN'":
Rav Chanina bar Avdimi cited Rav: The halacha is like Rabbi Meir.
And the halacha is not like him, for we establish that slaves are like movable objects.

{Bava Kamma 97a}
אמר רב דניאל בר רב קטינא אמר רב התוקף בעבדו של חבירו ועשה בו מלאכה פטור והוא שלא בטלו ממלאכה
מ"ט ניחא ליה לאיניש דלא ניסתרו עבדיה:
Rav Daniel bar Rav Katina cited Rav: if a man forcibly seizes another's slave and makes him perform some work, he would be exempt {from any payment}.
And this where he did not make his neglect his work {for his owner}. What is the reason: A person is pleased that his slave should not become prone to idleness.

רב יוסף בר חמא הוה תקיף עבדי דאינשי דמסיק בהו זוזי ועביד בהו מלאכה
א"ל רבא בריה מ"ט עביד מר הכי
אמר ליה דאמר רב דניאל בר רב קטינא אמר רב התוקף בעבדו של חבירו ועשה בו מלאכה פטור
א"ל ה"מ היכא דלא מסיק בהו זוזי מר כיון דמסיק בהו זוזי מיחזי כרבית
תדע דהא אמר רב יוסף בר מניומי אמר רב נחמן אע"פ שאמרו הדר בחצר חבירו שלא מדעתו אינו צריך להעלות לו שכר הלוהו ודר בחצרו צריך להעלות לו שכר
א"ל הדרי בי:
{Our gemara: people of the house of} Rav Yosef bar Chama used to seize slaves of people who owed them money, and make them perform some work.
Rava his son {this is Rava} said to him: Why does Master do so?
He said to him: For Rav Daniel bar Rav Katina cited Rav: if a man forcibly seizes another's slave and makes him perform some work, he would be exempt {from any payment}.
He {=Rava} said to him: These words are where he has no money claim against the owner, but Master, since you have a money claim against the owner, it looks like usury. Know this, for behold, Rav Yosef bar Minyumi cited Rav Nachman: Even though the Rabbis decided that one who occupies another's premises without his consent is not liable to pay him rent, if he lent money to another and then occupied his premises he would have to pay him rent.
He said to him: I retract.

איתמר התוקף ספינתו של חבירו ועשה בו מלאכה
[אמר רב] אם רצה שכרה נוטל רצה פחתה נוטל
ושמואל אמר אינו נוטל אלא פחתה
אמר רב פפא ולא פליגי הא דעבידא לאגרא והא דלא עבידא לאגרא
ואי בעית אימא הא והא דעבידא לאגרא
ולא קשיא הא דנחית לה בתורת אגרא והא דנחית לה בתורת גזלנותא:
It was stated {by Amoraim}: If one forcibly seizes another's ship and performs some work with it:
[Rav said:] If he {=the owner} wishes, he may take its hire, and if he wishes, he may demand payment for its wear and tear.
And Shmuel said: He may demand only for its wear and tear.
Rav Pappa said: They do not argue. Here is where it {=the ship} was made {or: was regularly} for hire, where here is where is was not made for hire. And if you want, say that here and here, where it was made for hire, and it is no contradiction. Here, where possession was taken of it with the intention of paying the hire, and here, where possession was taken of it with the intention of robbery.

גזל מטבע ונסדק וכו'
אמר רב הונא נסדק נסדק ממש נפסל שפסלתו מלכות
ורב יהודה אמר אפילו פסלתו מלכות נמי היינו נסדק
אלא היכי דמי נפסל שפסלתו מדינה זו ויוצא במדינה אחרת
"IF HE MISAPPROPRIATED A COIN AND IT BECAME CRACKED...":
Rav Huna said: IT BECAME CRACKED means that it actually cracked, [and] IT WENT OUT OF USE {/became invalid} means that the Government declared it obsolete.
And Rav Yehuda said: where the Government declared the coin obsolete it would be tantamount to its being cracked. Rather, how so IT WENT OUT OF USE? The inhabitants of a particular province rejected it while it was still in circulation in another province.

איתמר המלוה את חבירו על המטבע ונפסל המטבע
אמר רב נותן לו
It was stated {by Amoraim}:
If a man lends his fellow on {condition that it should be repaid in} a certain coin, and that coin became obsolete:
Rav said: He gives him
