אמר רבא הלכתא מקיימין את השטר שלא בפני בעל דין ואפי' עומד וצווח:
ואי אמר קיבעו זימנא דמייתינא סהדי ומרענא ליה לשטרא קבעינן ליה.
ואי לא אתו בזימניה נטרינן ליה שני וחמישי ושני ואי לא אתא כתבינן פתיחא עליה ומשהינן ליה תשעין יומין
תלתין יומין קמאי לא כתבינן אדרכתא אניכסיה דאמרינן דלמא אזוזי קא טרח.
תלתין יומין מציעאי לא כתבינן אדרכתא אניכסיה דאמרינן דלמא לא אשכח למיזף וקא טרח לזבוני.
שלשים יום בתראי לא כתבינן אדרכתא אניכסיה דאמרי' דלמא ההוא דקא זבין גופיה קא טרח אזוזי
מכאן ואילך ודאי כתבינן אדרכתא אניכסיה

Rava said: The law is that a document may be authenticated even not in the presence of the other party; and even if he protests aloud before us {that the document is a forgery}.
And if he says, 'Give me time till I can bring witnesses, and I will invalidate the document', we give him time. And if he does not appear we wait again over the following Monday and Thursday and Monday. If he still does not appear we write a Peticha {=a warrant} out against him and wait for him for ninety days.
For the first thirty days we do not take possession of his property as we say that he is busy trying to borrow money; during the middle thirty we similarly do not take possession of his property as we say perhaps he was unable to raise a loan and is trying to sell his property; during the last thirty days we similarly cannot take possession of his property as we still say that the purchaser himself is busy trying to raise the money. From then on, we certainly write an adrachta {=a legal order to trace the debtor's property for the purpose of having it seized and assessed to the creditor for his debt} on his property.

והנ"מ דקא מישתמיט אישתמוטי ואמר אתינא [אתינא] אבל אמר לא אתינא לאלתר כתבינן אדרכתא אניכסיה
והני מילי מלוה אבל פקדון לאלתר כתבינן אדרכתא אנכסיה
והני מילי אמקרקעי אבל אמטלטלי לא כתבינן מ"ט דלמא שמיט ואכיל להו ומייתי האיך סהדי ומרע ליה לשטרא וליכא לאשתלומי מיניה
ואפי' אית ליה למלוה מקרקעי לא כתבינן ליה אדרכתא אמטלטלי דחיישינן דלמא מיכספן הנך מקרקעי וליכא לאישתלומי מיני'
וכי כתבינן אדרכתא אניכסיה מודעינן ליה והוא דמקרב כגון דאזיל שליחא בתלתא בשבא ואתי בארבעה בשבא וקאי בחמשה בבי דינא:

And these words are where he pleads 'I will come {/bring}, I will come}', but if he says 'I will not come', we immediately write an adrachta on his property.
And these words are regarding a loan, but regarding a pledge, we immediately write an adrachta on his property.
And these words are regarding land, but upon movable object we do not write {an adrachta}. What is the reason? Lest he meanwhile carry them off and consume them; and when these one brings witnesses and invalidates the document, there be nothing to pay him from.
And even where the creditor has land, we do not write an adrachta on movable objects, for we fear lest this land may depreciate in value and there not be what to repay from.
And when we write an adrachta on his property, we inform him. And this is where he is nearby, such as that an agent {of the court} leaves {to him} on Tuesday and comes on Wednesday, and he can appear on Thursday in Bet Din.

אמר רבא שליחא דבי דינא מהימן כבי תרי
והנ"מ לשמתא אבל לפתיחא לא
מ"ט ממונא הוא דקא מחסר ליה דבעי מיתב זוזא דפתיחא:

Rava {our gemara: Ravina} said: The agent of Ben Din is believed like a set of two {witnesses, that the party refused to come to court}.
And these words are in terms of placing him under the ban, but for a Peticha {=warrant}, no.
What is the reason? Because it is monetary matters which he is causing him loss, for he needs to give money for the Peticha. {our gemara: for the scribe; but Tosafot have Peticha}.

ואמר רבא קבעינן ויהבינן זימנא אפומי דאיתתא ואפומי דשיבבא ולא אמרן אלא דליתא במתא אבל איתיה במתא לא
מ"ט לא א"ל סברי אשכחיה שליחא וא"ל

And Rava {our gemara: Ravina} said: We establish and give a fixed date {for a summons} on the word of a woman, and on the word of a neighbor.
And we only say this where he {=the party} was not in the town,
{Bava Kamma 113a}
but if he is in town, no.
What is the reason? They {=the woman or neighbor} might not tell him, thinking that the agent will find him and tell him.
